• Payment Information. Billing name, billing address, and payment card details, collected and processed securely through our third-party payment processor, Stripe. We do not store full payment card numbers on our systems.
• Communication Information. The content of emails, messages, and other communications you send to us, including feedback, support requests, and consultation notes.
• Marketing Preferences. Your choices about receiving newsletters, promotional communications, and other marketing materials, for example when you subscribe to our mailing list through Mailchimp.
• Scheduling Information. Name, email, and scheduling preferences you provide when booking a consultation through Calendly.

2.2 Information Collected Automatically

When you visit the Site, we and our third-party service providers automatically collect certain information, including:

However, our use of certain advertising technologies (such as Google Ads remarketing and Yelp Ads) may constitute “sharing” or “sale” of personal information under the Texas Data Privacy and Security Act (TDPSA) and the California Consumer Privacy Act (CCPA/CPRA), as those terms are defined under those laws. We may disclose your personal information to the following categories of third parties:

• Service Providers. Companies that perform services on our behalf, such as payment processing, email delivery, hosting, analytics, and scheduling. These providers are contractually obligated to use your information only to provide services to us and in accordance with this Policy.

5.1 Google Analytics

We use Google Analytics 4 for website analytics. Google Analytics collects device information, browser information, IP address (anonymized), browsing behavior, page views, session duration, and demographic data. 5.2 How These Services Are Loaded

We do not use a tag management system. The third-party services described in this Section are loaded directly by our Site’s own code, and only after you have granted the corresponding consent category. Where consent has not been granted, the service is not loaded and receives no request from your browser.

The Google Analytics and Google Ads libraries are served from the domain www.googletagmanager.com, which is Google’s delivery address for its gtag.js library. Its appearance does not indicate the use of a Google Tag Manager container.

5.3 Google Ads

We use Google Ads for remarketing and targeted advertising. Google may collect and use cookies, device identifiers, and browsing data from our Site to show you targeted advertisements on Google’s network. See: Google Ads Privacy. You can manage your ad preferences at Google Ad Settings.

5.4 Yelp Ads

We use Yelp’s advertising platform to promote our services. Yelp may collect browsing and interaction data in connection with our advertisements. See: Yelp Privacy Policy.

5.5 Stripe

We use Stripe for payment processing, including checkout, receipts, and promo codes. Stripe receives your name, email address, payment details, and transaction metadata. We do not store full payment card numbers. See: Stripe Privacy Policy.

5.6 Resend

We use Resend to send transactional emails, including consultation confirmations, quote requests, contact form replies, and payment receipts. Resend processes your name, email address, and message content. See: Resend Privacy Policy.

5.7 Mailchimp

We use Mailchimp for newsletter subscriptions and email marketing. When you subscribe, your email address and any additional information you provide are stored and managed by Mailchimp. See: Mailchimp Privacy Policy.

5.8 Supabase

We use Supabase for authentication and database storage, including order records and session data. See: Supabase Privacy Policy.

5.9 Calendly

We embed Calendly for scheduling consultations. When you book a consultation, Calendly collects your name, email address, and scheduling preferences. See: Calendly Privacy Policy.

5.10 Microsoft Clarity

We use Microsoft Clarity for session recording and heatmap analytics. Clarity may record your session activity, including mouse movements, clicks, scrolls, and page interactions, along with device and browser information. Session recordings help us understand how visitors use the Site and identify areas for improvement. 5.11 Vercel

Our Site is hosted on Vercel. Vercel may log request metadata (such as IP address, request URL, and timestamps) for operational and security purposes. See: Vercel Privacy Policy.

6. Targeted Advertising and Data Sharing

We use Google Ads and Yelp Ads to deliver targeted advertisements to users based on their interactions with our Site. This involves sharing certain personal information, such as cookie identifiers, device identifiers, IP addresses, and browsing behavior, with these advertising platforms.

Under the TDPSA and CCPA/CPRA, this sharing may be classified as a “sale” of personal information or “sharing” for cross-context behavioral advertising, even though we do not receive monetary payment in exchange.

• Opt Out. Opt out of the processing of your personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects.

8.2 Rights Under the California Consumer Privacy Act (CCPA/CPRA)

8.3 How to Exercise Your Rights

You may exercise any of the rights described above by:

• Using the “Do Not Sell or Share My Personal Information” link on our Site to opt out of targeted advertising and data sharing.
• Enabling the Global Privacy Control (GPC) signal in your browser. We recognize and honor GPC signals as a valid opt-out request for the sale of personal data and targeted advertising, as required by the TDPSA (effective January 1, 2025) and the CCPA/CPRA.

We will respond to verifiable requests within 45 days of receipt. If we need additional time, we will notify you of the extension and the reason for it. We may request information from you to verify your identity before fulfilling your request.

8.4 Appeal Process

If we decline your privacy rights request, you may appeal our decision by emailing privacy@andpixels.com with the subject line “Privacy Rights Appeal.” We will respond to your appeal within 60 days. If your appeal is denied, we will provide you with information on how to contact the Texas Attorney General’s office or the California Attorney General’s office, as applicable, to submit a complaint.

8.5 Authorized Agents

You may designate an authorized agent to submit a privacy rights request on your behalf. We may require the agent to provide proof of authorization (such as a signed written authorization or power of attorney) and may require you to verify your identity directly with us.

9. Do Not Sell or Share My Personal Information

We provide a “Do Not Sell or Share My Personal Information” link on our Site. Clicking this link allows you to opt out of the sharing of your personal information with advertising partners (including Google Ads and Yelp Ads) for targeted advertising purposes.

When you opt out, we will stop sharing your personal information with these advertising partners for targeted advertising. This opt-out does not affect our use of your information for other purposes described in this Policy (such as providing services, responding to inquiries, or sending transactional communications).

We also recognize and honor browser-based Global Privacy Control (GPC) signals as an opt-out of the sale and sharing of personal information.

10. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes described in this Policy, including providing our services, maintaining our business records, complying with legal obligations, resolving disputes, and enforcing our agreements.

Our general retention practices are:

• Client and Project Data. Retained for the duration of the client relationship and indefinitely thereafter for business records, portfolio documentation, and legal compliance purposes.
• Contact and Inquiry Data. Retained indefinitely to maintain our business relationships and communication history.
• Marketing and Newsletter Data. Retained until you unsubscribe or request deletion.
• Payment and Transaction Data. Retained for a minimum of seven (7) years for tax and accounting compliance.
• Analytics and Usage Data. Retention periods are determined by the applicable third-party analytics provider (see Section 5).
• Session Recordings (Microsoft Clarity). Retained according to Microsoft’s data retention schedule.

No method of transmission over the internet or electronic storage is completely secure. While we strive to protect your personal information, we cannot guarantee its absolute security.

12. Children’s Privacy

Our Site and services are not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18.
